1. General information

This website latualuna.it (“Site”) is owned and operated by Web42 Srl, with registered office at Via Piazza D’armi 3, 06049 Spoleto (PG), Italy, VAT no. 03714120544, REA PG – 308828, email address info@web42.it, telephone +39 0744 1925851 (“Seller”).

These Terms and Conditions of Sale (“Conditions”) govern the sale of products offered on the Site pursuant to Italian Legislative Decree 206/2005 (Consumer Code) and Legislative Decree 70/2003 (Electronic Commerce).

Purchasing from the Site implies full acceptance of these Conditions. Customers are invited to read them carefully before placing an order.


2. Definitions

  • Product: fine art photographic print of the Moon, made on commission for the date chosen by the Customer, including a certificate of authenticity.
  • Customer: the natural person who makes a purchase on the Site for purposes unrelated to any business, commercial, craft or professional activity carried out (consumer pursuant to Article 3, paragraph 1, letter a) of the Italian Consumer Code).
  • Order: the booking made by the Customer for the realization of the photographic print on the chosen date.
  • Chosen Night: the date selected by the Customer, or possibly the following date if the shot is taken after midnight, on which the photographic shot of the Moon will be made.

3. Nature of the product

The Product offered on latualuna.it is a commissioned photographic work. Each print is the result of a real astrophotographic shot, taken on the Chosen Night by the Customer, and subsequently printed on museum-quality fine art paper.

The Product is not a digital rendering, nor a graphic reconstruction, nor an archive image. The photograph is taken exclusively on the night indicated by the Customer at the time of ordering.

3.1 Technical specifications of the product

  • Print format: 40 × 40 cm
  • Paper: Hahnemühle Photo Rag® 308 g/m²
  • Printing technique: museum-quality pigment giclée
  • Estimated conservation: over 100 years under appropriate conditions
  • Certificate of authenticity with technical data of the shot, personalized dedication and progressive number
  • Exclusive page accessible via QR code on the certificate

3.2 Caring for your print

The estimated duration of over 100 years of the print is subject to adequate conservation conditions: no direct sunlight exposure, controlled temperature and humidity environment (ideally 18-22°C and 30-50% relative humidity), no temperature fluctuations or smoky environments, handling the print by the edges without direct contact with the printed surface. If displayed in a frame, the use of UV-protective glass is recommended.

To remove dust, use a soft natural-bristle brush with gentle movements. Do not use cloths, water, or cleaning products.

Conservation instructions are provided with the Product.


4. Purchase procedure

4.1 Date selection

The Customer selects the Chosen Night through the interactive calendar on the Site. The calendar shows the expected lunar phase for each night and indicates which nights are available for booking.

The lunar phases and illumination values shown in the calendar are astronomical predictions calculated based on public ephemeris, referring to the observation point coordinates in central Umbria and calculated for midday of the selected day. The actual values at the moment of the shot may differ slightly from those shown in the calendar, as the Moon is in continuous motion. The precise astronomical data at the moment of the shot are reported on the certificate of authenticity.

Nights on which the Moon is not visible (New Moon phase, illumination less than 5%) cannot be booked. Nights marked as “unavailable” by the Photographer cannot be booked for organizational reasons.

4.2 Personalization

The Customer indicates:

  • The chosen night date (mandatory)
  • The occasion of the gift (mandatory)
  • The recipient’s name (mandatory)
  • A personalized dedication for the certificate (optional)
  • Additional notes (optional)

4.3 Confirmation and payment

The order is finalized upon payment of the full amount. Payment can be made by credit/debit card (Visa, Mastercard, American Express), Apple Pay, Google Pay or PayPal.

Order confirmation is sent to the Customer via email to the address provided during the purchase.

4.4 Nature of the order

The order constitutes a booking for the realization of the photographic shot on the Chosen Night. The shot is subject to weather conditions (cfr. art. 7).


5. Prices and payments

5.1 Prices

All prices indicated on the Site include VAT. The price applied is the one displayed on the Site at the time of placing the order.

5.2 Shipping costs

Shipping costs, if applicable, are indicated separately during the purchase procedure and before order confirmation.

5.3 Invoicing

An electronic invoice is issued for every purchase. The Customer is required to provide the data necessary for invoicing during the purchase: tax code (codice fiscale) for private individuals; company name, VAT number and SDI code or PEC for entities with a VAT number.


6. Production and delivery times

6.1 Production

The photographic shot takes place on the Chosen Night, subject to weather conditions. After the shot, the image processing, printing and packaging process takes approximately 7-10 working days.

6.2 Shipping

Shipping is by express courier with tracking. Delivery times in Italy are 2-4 working days from the date of shipment. The Customer receives a notification via email with the tracking number at the time of shipment.

6.3 Total times

The total time from the Chosen Night to delivery is approximately 10-14 working days, subject to weather contingencies (cfr. art. 7) or courier delays.

6.4 Delivery address

The Product can be shipped to the Customer’s address or directly to the gift recipient, as indicated by the Customer at the time of purchase.


7. Weather conditions

7.1 Weather dependency

The realization of the photographic shot depends on weather conditions. Overcast skies, rain, fog or other adverse conditions may prevent the shot from being taken on the Chosen Night.

7.2 Procedure in case of adverse weather

If weather conditions do not allow the shot on the Chosen Night, the Seller promptly notifies the Customer via email. The Customer can choose between:

a) Postponing the shot to the next available night with favorable weather conditions, agreed with the Seller;

b) Obtaining a full refund of the amount paid, which will be processed within 5 working days from the request using the same payment method used for the purchase.

7.3 Authenticity

The dependence on weather conditions is an integral part of the authenticity of the Product. The Seller does not under any circumstances use archive images, digital renderings or graphic reconstructions to make up for the impossibility of taking the shot.


8. Right of withdrawal

8.1 Exclusion of the right of withdrawal

Pursuant to Article 59, paragraph 1, letter c) of Legislative Decree 206/2005 (Italian Consumer Code), the right of withdrawal is excluded for custom-made or clearly personalized goods.

The Product offered on latualuna.it is made entirely on commission for the individual Customer, with specific date, dedication and recipient. Therefore, it is not possible to exercise the right of withdrawal after the photographic shot has been taken.

8.2 Cancellation before the shot

The Customer can cancel the order and obtain a full refund before the Chosen Night, by communicating the request via email to info@latualuna.it. If the shot has already been taken, no refund is possible.

8.3 Satisfaction guarantee

In case of printing defects, damage during transport or evident discrepancies of the Product compared to what was described, the Customer can contact the Seller within 14 days of receipt. The Seller will reprint and reship the Product at its own expense, or provide a full refund at the Customer’s choice.


9. Legal guarantee of conformity

The Product is covered by the legal guarantee of conformity pursuant to Articles 128-135 of the Italian Consumer Code. The Seller is responsible to the Customer for any lack of conformity existing at the time of delivery of the Product and which manifests itself within 2 years from delivery.

In the event of a lack of conformity, the Customer is entitled to the restoration of the Product’s conformity by repair or replacement, or to a price reduction or termination of the contract, under the terms and conditions provided by law.


10. Intellectual property

10.1 Copyright

The photographs taken by the Seller are works of intellectual creation protected by Italian Copyright Law (Law 633/1941). The Seller retains all intellectual property rights to the images.

10.2 License of use

By purchasing the Product, the Customer acquires the right to use the print exclusively for personal and domestic use (private display, gift). Reproduction, distribution, sale or any commercial use of the image is not permitted without the prior written consent of the Seller.

10.3 Use by the Seller

The Seller reserves the right to use the photographs (without the Customer’s personal data) for promotional purposes, portfolio and on its own communication channels. Should the Seller wish to use images or testimonials that include the Customer’s personal data, explicit and prior consent will always be requested.


11. Limitation of liability

11.1 Photographic result

The aesthetic result of the photograph depends on factors not entirely controllable (residual atmospheric conditions, astronomical seeing, lunar phase). The Seller undertakes to take every shot with the utmost care and professionalism, but cannot guarantee a result identical to images previously published as examples.

11.2 Color and rendering of the print

Slight differences in color and tonality between the image displayed on screen and the fine art print are physiological and due to the difference between the rendering of digital monitors and that of art print paper. Such differences do not constitute a defect of the Product.

11.3 Damage during transport

The Seller packages the Product with the utmost care to ensure its integrity during transport. In case of evident damage to the packaging at the time of delivery, the Customer is invited to report the reserve to the courier and to contact the Seller promptly. The Seller will replace the Product at its own expense.


12. Personal data processing

The Customer’s personal data are processed in compliance with EU Regulation 2016/679 (GDPR) and Italian Legislative Decree 196/2003 as amended by Legislative Decree 101/2018. For all details on data processing, please refer to the Privacy Policy.

The personal data provided by the Customer at the time of purchase (name, address, email, dedication, recipient’s name) are processed exclusively for the purposes of executing the sales contract and, where applicable, for issuing the invoice.

The dedication and the recipient’s name are printed on the certificate of authenticity and on the private page accessible via QR code. The Customer is aware of this and consents at the time of entering such information.


13. Communications

All communications relating to the order (confirmation, updates on the shot, shipping notification) are sent to the email address provided by the Customer at the time of purchase.

14. Alternative Dispute Resolution (ADR/ODR)

Pursuant to Article 141-sexies, paragraph 3, of the Italian Consumer Code, the Seller informs the Customer that, in the event that the Customer has filed a complaint directly with the Seller and it has not been possible to resolve the dispute, the Seller will provide information on the Alternative Dispute Resolution (ADR) body for the out-of-court resolution of disputes.

The Seller also informs the Customer of the existence of the European Online Dispute Resolution platform (ODR platform), accessible at the following address: https://ec.europa.eu/consumers/odr/


15. Applicable law and jurisdiction

These Conditions are governed by Italian law. For any dispute relating to the interpretation, execution or termination of these Conditions, the Court of the place of residence or domicile of the Customer/consumer shall have jurisdiction, pursuant to Article 66-bis of the Italian Consumer Code.


16. Modifications to the Conditions

The Seller reserves the right to modify these Conditions at any time. Modifications will be effective from the date of publication on the Site. Orders placed before the modification are subject to the Conditions in force at the time of the order.
